Terms of Service

Last updated: [Effective Date]

Legal review required. This document contains bracketed placeholders such as [Jurisdiction] that must be completed and reviewed by qualified counsel before publication.

1. These terms

These terms govern all set design, fabrication, finishing, lighting and on-set services provided by SceneCraft Studio, [Registered Address], registered in [Jurisdiction]. They apply together with the signed quotation or statement of work for a project, which prevails where the two conflict.

2. Quotations and acceptance

Quotations are valid for [Quote Validity Period] and are based on the brief, drawings and material samples described in them. A project is accepted when you sign the quotation or issue a purchase order referencing it, and the booking deposit has cleared.

3. Fees, deposits and payment

  • A booking deposit of [Deposit Percentage] is payable to reserve build dates.
  • The balance is invoiced on [Balance Trigger] and payable within [Payment Term] days.
  • Late payments accrue interest at [Interest Rate] as permitted by the law of [Jurisdiction].
  • Fees exclude [Tax Name] and any transport, storage, permit or standby-crew costs unless listed in the quotation.

4. Changes to scope

Changes to design, materials, dimensions, schedule or shoot location after approval are quoted as a variation and must be approved in writing before work continues. Changes requested within [Change Freeze Window] of a build date may not be achievable, and we will say so rather than compromise the set.

5. Client responsibilities

You are responsible for providing accurate stage dimensions, access details and load-in times, for securing permits and site permissions, for supplying product, wardrobe or props on the agreed date, and for ensuring the shoot location is safe and available. Delays caused by these items may move the schedule and incur standby charges.

6. Ownership of sets and materials

Unless the quotation states otherwise, physical sets, structures, jigs and reusable staging systems remain the property of SceneCraft Studio and are struck and disposed of or returned to our store after the shoot. Storage of set elements is available at [Storage Rate] and must be arranged before the build starts.

7. Intellectual property

Design drawings, concept artwork, finish specifications and technical documentation remain our intellectual property. On full payment you receive a non-exclusive licence to use them for the commissioned production. We retain the right to photograph our builds and to feature them in our portfolio, subject to any embargo period agreed in writing.

8. Health, safety and insurance

We work to the health and safety requirements of [Jurisdiction] and carry public liability insurance of [Insurance Cover Amount]. You must hold production insurance appropriate to the shoot. Neither party may instruct crew to work in conditions that breach applicable safety rules.

9. Cancellation

Cancellation and postponement charges are set out in our Refund Policy, which forms part of these terms.

10. Liability

Our total liability arising from a project is limited to the fees paid for that project. We are not liable for indirect or consequential loss, including lost production time, talent fees or lost revenue, except where liability cannot be limited under the law of [Jurisdiction].

11. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including extreme weather, utility failure, industrial action, or restrictions imposed by authorities in [Jurisdiction].

12. Governing law

These terms are governed by the laws of [Jurisdiction], and the courts of [Jurisdiction] have exclusive jurisdiction. Questions: contact@prismis.site.
